1. Acceptance of Terms

By accessing or using PhonoBaby.com ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. PhonoBaby is owned and operated by LoudonClear LLC.

2. Description of Service

PhonoBaby is a web-based application that uses your voice input to generate unique 3D sculptures and related audio keepsakes. The Service allows you to record audio, create 3D models, and optionally save, share, and download your creations.

3. User Accounts

You may use certain features of the Service without creating an account. To save, download, or share your creations, you must register for a free account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. Your Content and Voice Recordings

You retain ownership of all audio recordings and resulting 3D models you create through the Service ("Your Content").

By using the Service, you grant LoudonClear LLC a limited, non-exclusive, royalty-free license to process and store Your Content solely for the purpose of providing the Service to you. We do not use your voice recordings to train AI models or share them with third parties, except as required to operate the Service (e.g., cloud storage providers).

You represent that you have the right to submit any audio content you record and that such content does not violate the rights of any third party.

5. Prohibited Uses

You agree not to use the Service to:
  • Record or submit any audio that is illegal, defamatory, threatening, or harassing
  • Infringe on any third party's intellectual property rights
  • Attempt to reverse-engineer, scrape, or disrupt the Service
  • Use the Service for any commercial purpose without prior written consent from LoudonClear LLC
  • Create accounts or submit content using automated means

6. Credits and Payments

The Service offers free credits and paid credit packs or subscription plans. All purchases are processed securely through Stripe. Payments are non-refundable except where required by applicable law.

Free credits are provided as a courtesy and may be modified or discontinued at any time without notice. Purchased credits do not expire while your account remains active.

7. Data Retention

Free tier users may have their saved sculptures removed after 7 days of inactivity or expiration. Paid ("Unlimited") users retain access to their creations for the duration of their active subscription. LoudonClear LLC is not liable for loss of data due to account inactivity, cancellation, or technical issues.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. LoudonClear LLC does not warrant that the Service will be uninterrupted, error-free, or free of viruses. You use the Service at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, LoudonClear LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages.

10. Changes to Terms

LoudonClear LLC reserves the right to modify these Terms at any time. We will notify users of significant changes by updating the "Last updated" date above. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions.
